Welcome to MoodMirror. This User Agreement is entered into between you and the operator of MoodMirror regarding your access, registration, login, use, purchase, or other acceptance of the service.

Please read and fully understand this Agreement before using the service, especially the provisions regarding account security, user content, AI outputs, paid subscriptions, disclaimers, limitation of liability, and dispute resolution. If you do not agree to this Agreement, please stop using the service. By continuing to use the service, you are deemed to have accepted this Agreement.

1. Definitions and Scope

1. MoodMirror is a Web/H5 service focused on drawing-based emotional expression, AI emotional insights, AI companion conversations, mood records, trend tracking, and membership benefits. MoodMirror AI refers to the AI companion and insight features within the product.

2. “User” or “you” means any natural person, legal entity, or organization that directly or indirectly accesses, logs in to, or uses the service.

3. “User Content” means content you submit, upload, draw, enter, generate, or save while using the service, including drawings, images, avatars, nicknames, chat text, mood journals, feedback, comments, order notes, and related metadata.

4. This Agreement applies to the website, H5 pages, PWA, embedded pages, future client versions, and other related services we provide. Some features may have separate rules, which form part of this Agreement together with these terms.

2. Service Content

We may provide all or part of the following services. The actual available features are subject to what is released in the product:

We may adjust, suspend, or terminate certain features based on product planning, compliance requirements, business arrangements, technical conditions, or user feedback, and will notify you in an appropriate manner where necessary.

3. Account Registration, Login, and Security

1. You may log in as a guest, through email verification, Google, Apple, or other supported methods. You must ensure that the information you provide is true, lawful, valid, and kept up to date.

2. Account use rights belong only to the initial registrant or lawful authorized user. Without our written consent, you may not rent, lend, transfer, sell, share, gift, or otherwise dispose of your account or membership benefits.

3. You are responsible for properly safeguarding your account, verification codes, login devices, and browser login status. Losses caused by your disclosure, account sharing, unsafe devices, or unauthorized use by others shall be borne by you, unless otherwise required by law.

4. Data in guest mode depends on device, browser, or local identifiers. If you clear browser data, change devices, uninstall the PWA, reinstall the system, or local identifiers become invalid, guest account data, local drafts, recent conversations, and similar data may not be recoverable.

5. If we discover or reasonably suspect unlawful activity, fraud, abnormal requests, batch registration, abuse of free quota, system attacks, circumvention of paid limits, or infringement of others' rights, we may verify identity, restrict features, suspend service, freeze benefits, or terminate the account.

4. User Content and Conduct Rules

1. You are solely responsible for User Content that you submit, upload, draw, enter, or distribute. You must ensure that your User Content does not infringe any third party's intellectual property rights, portrait rights, privacy rights, reputation rights, personal information rights, or other lawful rights.

2. You retain the rights you lawfully own in your original User Content. To provide saving, display, analysis, report generation, AI conversation, trend statistics, customer support, safety review, and product improvement services, you grant us a worldwide, non-exclusive, sublicensable, royalty-free license to use User Content within the scope necessary to copy, store, cache, transcode, compress, display, analyze, generate derivative outputs, conduct safety governance, and provide the service. Unless separately authorized, we will not use your private drawings or chat content for external marketing.

4. We may conduct necessary review, risk control, complaint handling, and safety measures for User Content and behavior, including reminders, refusal to publish, deletion, blocking, usage restrictions, account termination, record preservation, and reporting to authorities where required.

5. Special Terms for AI Services

1. MoodMirror's AI drawing analysis and MoodMirror AI companion conversations are intended to support emotional expression, self-awareness, and general companionship. They do not constitute medical, psychological therapy, psychological diagnosis, legal, financial, or other professional advice.

2. AI outputs may be affected by input content, model capability, context length, data quality, and system status. They may be inaccurate, incomplete, delayed, interrupted, repetitive, or unsuitable for your situation. You should use your own judgment and adopt outputs cautiously.

3. The service does not and cannot replace professional counseling, medical diagnosis, treatment, or emergency assistance. If you are experiencing self-harm thoughts, suicidal ideation, potential harm to others, acute psychological crisis, or another emergency, please immediately contact local emergency services, a medical institution, a crisis hotline, or a trusted person.

4. You may not induce AI to generate illegal, harmful, infringing, harassing, fraudulent, moderation-evading, system-attacking, or security-risk content. We may limit, block, downgrade, or record related inputs and outputs to protect service safety.

5. AI outputs do not represent our position. Except as otherwise required by law, you are responsible for the consequences of actions taken in reliance on AI outputs.

6. Memberships, Subscriptions, Analysis Packs, and Payments

1. We may provide free quota, membership subscriptions, one-time analysis packs, campaign quota, or other paid benefits. Specific prices, currencies, validity periods, benefit scope, daily quota, available features, and payment methods are subject to what is displayed on the purchase page.

2. Membership subscriptions are generally used to increase drawing analysis quota, AI chat quota, trend-viewing capability, or other premium benefits. Analysis packs generally add usage counts for specific features and do not necessarily increase daily quota, membership level, or other subscription benefits.

3. You should pay through official channels displayed in the product. Third-party payment platforms may apply their own service terms, privacy policies, refund rules, tax rules, and subscription management rules.

4. If a product is an auto-renewing subscription, the renewal cycle, charge amount, charge time, cancellation method, and management entry are subject to the purchase page, payment platform, or account settings. You are responsible for canceling unwanted subscriptions before the next billing cycle.

5. After successful payment, we will deliver benefits based on payment platform callbacks, order queries, or verification results. Benefit delivery may be delayed due to network latency, payment platform processing, or risk review.

6. Unless otherwise required by law, purchase page descriptions, or payment platform rules, virtual benefits, subscription services, analysis packs, and consumed quota generally do not support no-reason refunds. If duplicate charges, missing benefits, or abnormal orders occur, please contact us promptly and provide order information.

7. If we discover fraudulent payment, refund abuse, stolen payment, payment bypassing, malicious benefit exploitation, or violation of this Agreement, we may suspend or recover related benefits and pursue legal responsibility.

7. Intellectual Property

1. Intellectual property rights in the service and its code, interface, interactions, marks, trademarks, graphics, text, audio/video, model configurations, algorithmic workflows, data structures, analysis templates, report styles, and commercial plans belong to us or the relevant rights holders.

2. Without written permission from us or the rights holder, you may not copy, adapt, translate, reverse engineer, decompile, scrape, mirror, sell, rent, distribute, train competing models on, or otherwise commercially use the service or its content.

3. AI outputs generated through your use of the service may be used for your personal, non-commercial purposes, provided that such use does not violate laws, this Agreement, third-party rights, or service rules. For public release, commercial use, professional scenarios, or third-party materials, you are responsible for confirming rights and compliance requirements.

8. Privacy and Personal Information Protection

We process your personal information in accordance with the MoodMirror Privacy Policy. The Privacy Policy is an integral part of this Agreement. Matters not expressly covered in this Agreement regarding personal information protection shall be governed by the Privacy Policy.

9. Service Changes, Interruption, and Termination

1. To maintain security, optimize experience, upgrade systems, handle failures, respond to legal requirements, or adjust business operations, we may maintain, upgrade, suspend, restrict, or terminate the service. We will provide advance or timely notice where reasonably possible, except in emergencies.

2. We will make reasonable efforts to address service abnormalities, interruptions, data delays, or feature unavailability caused by force majeure, telecom carriers, cloud services, payment platforms, third-party AI services, cyberattacks, policy changes, device compatibility, browser restrictions, or other reasons beyond our control.

3. If you do not log in for a long period, voluntarily cancel your account, seriously violate this Agreement, laws, regulations, or platform rules, we may terminate all or part of the service to you and process related data and benefits in accordance with law.

10. Disclaimers and Limitation of Liability

1. The service is provided on an “as is” and “as available” basis. We will work to keep the service stable, secure, and accurate, but we do not guarantee that the service will be uninterrupted, error-free, or fully meet your specific needs, nor do we guarantee that AI outputs will be absolutely accurate or suitable for every situation.

2. You understand that emotional drawing analysis and AI companionship are subjective, probabilistic, and non-diagnostic. Reports, scores, labels, trends, and suggestions must not be used as the basis for medical diagnosis, treatment decisions, or crisis response.

3. To the extent permitted by law, we are not responsible for losses caused by your violation of this Agreement, incorrect operation, account leakage, reliance on AI outputs, uploading infringing content, use of third-party services, network issues, or device issues.

4. To the maximum extent permitted by law, we are not liable for indirect damages, lost profits, data loss, loss of goodwill, loss of expected benefits, or punitive damages. If liability must be assumed by law, our liability shall be limited to the amount you actually paid for the disputed service, unless otherwise mandatorily required by law.

11. Use by Minors

If you are a minor, you should use the service only with the consent and guidance of your legal guardian. Guardians should pay attention to minors' use of AI companion features, image uploads, membership purchases, and submission of personal information. If a guardian believes that a minor's use of the service is inappropriate, please contact us.

12. Updates to This Agreement

We may update this Agreement based on legal requirements, business adjustments, or feature changes. Material changes will be notified through page prompts, pop-ups, in-app notices, email, or other reasonable methods. After the updated Agreement takes effect, your continued use of the service means you accept the updated terms.

13. Governing Law and Dispute Resolution

The formation, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China, excluding conflict of law rules. Any dispute arising from this Agreement or the service shall first be resolved through friendly negotiation. If negotiation fails, either party may bring a lawsuit before a court with competent jurisdiction. If mandatory consumer protection, minor protection, or personal information protection laws in your region provide otherwise, those mandatory provisions shall apply.
